Terms of Service — Listing Studio

These Terms of Service ("Terms") govern your access to and use of Listing Studio. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.

Who we are Listing Studio ("Listing Studio", "we", "us" or "our") is operated as a sole proprietorship based in Sandton, South Africa. These Terms are governed by the laws of the Republic of South Africa.

1.The service

Listing Studio is a software platform that helps real estate professionals generate marketing content — including social media captions, posts, branded emails and AI-generated video — from a property listing URL or manually entered details. We may add, change or remove features from time to time to improve the service.

2.Eligibility & accounts

You must be at least 18 years old and legally able to enter into a contract to use Listing Studio. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

3.Subscriptions, billing & payment

Listing Studio is offered on a subscription basis, billed in South African Rand (ZAR) through our payment provider, Paystack.
Plans are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically until cancelled.
Certain features, such as video generation, may consume credits that can be purchased separately.
Prices may change; we will give you reasonable notice of any price change before it applies to you.

4.Cancellations & refunds

Cancel anytime — no refunds You may cancel your subscription at any time, and it will remain active until the end of your current paid billing period. We do not provide refunds or credits for partial periods, unused time, or unused credits, except where required by South African law.

To cancel, use the cancellation option in your account or contact us. After cancellation you will not be charged again, and access continues until the paid period ends.

5.Your content & responsibilities

You retain ownership of the content you submit (property details, images, branding and related material). By submitting content, you grant us a licence to process and use it solely to provide the service to you.

You are responsible for what you list and publish You confirm and warrant that, for every listing or piece of content you process through Listing Studio, you have the legal right and any required mandate, authorisation or consent to market that property and to use the images, information and third-party personal data involved. Listing Studio does not verify mandates, ownership, or the accuracy of any listing, and is not responsible for content you create, publish or distribute.

You are solely responsible for ensuring that your use of the service and any content you publish complies with all applicable laws and industry rules, including the Property Practitioners Act, advertising regulations, intellectual property law and POPIA.

6.AI-generated content

Always review AI outputs before publishing Listing Studio uses artificial intelligence to generate captions, text, imagery and video. AI-generated content may contain errors, inaccuracies or misrepresentations. You are responsible for reviewing, verifying and, where necessary, correcting all AI-generated outputs before publishing or distributing them. We do not warrant that AI-generated content is accurate, complete, lawful or fit for any particular purpose.

7.Acceptable use

Your use of Listing Studio is subject to our Acceptable Use Policy, which forms part of these Terms. We may suspend or terminate accounts that breach it.

8.Intellectual property

The Listing Studio platform, software, branding and underlying technology are and remain our property or that of our licensors. Nothing in these Terms transfers ownership of the platform to you. You may not copy, reverse-engineer, resell or create derivative works from the service without our written permission.

9.Service availability

We work to keep Listing Studio available and reliable, but we do not guarantee uninterrupted or error-free operation. The service is provided on an "as is" and "as available" basis. We may perform maintenance, updates or changes that temporarily affect availability.

10.Disclaimers & limitation of liability

To the fullest extent permitted by South African law:

We provide the service without warranties of any kind, whether express or implied, including as to accuracy, reliability, fitness for a particular purpose or non-infringement;
We are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, business, goodwill or data, arising from your use of or inability to use the service;
We are not responsible for how you or your clients use, publish or rely on any content generated through the service, including any listing marketed without a valid mandate or any inaccurate, misleading or unlawful content;
Our total liability to you for any claim arising out of or relating to the service is limited to the total amount you paid us in the three (3) months immediately before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under South African law, including under the Consumer Protection Act where it applies.

11.Indemnity

You agree to indemnify and hold Listing Studio harmless from any claims, losses, damages, liabilities and reasonable legal costs arising from your breach of these Terms, your misuse of the service, or your publication of content that infringes any law or third-party right — including marketing a property without the necessary mandate or authorisation.

12.Suspension & termination

We may suspend or terminate your access if you breach these Terms, misuse the service, or fail to pay. You may stop using the service and cancel at any time. Provisions that by their nature should survive termination (including liability, indemnity and intellectual property) will continue to apply.

13.Governing law & disputes

These Terms are governed by the laws of the Republic of South Africa. You agree to the jurisdiction of the South African courts. We encourage you to contact us first so we can try to resolve any dispute amicably.

14.Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and material changes will be communicated through the service or by email. Continued use after changes take effect means you accept the updated Terms.
